GENERAL Skylightsystems.com web service (the "Service") is owned and operated by Skylight Systems, Inc. ("Skylight Systems"). Skylight Systems and RFS are registered trademarks of Skylight Systems, Inc. The Service is the property of Skylight Systems, Inc. and its contents are protected by domestic and international copyright, trademark and other intellectual property laws. Users of the Service (individually, a "User" and collectively, "Users") may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any material from the Service, including code and software without the express written consent of Skylight Systems. As part of the Service, Skylight Systems agrees to provide Users with information and other services subject to these Terms of Service. Users agree to use the Service in accordance with these Terms of Service. Due to the nature of the World Wide Web, Skylight Systems may need to periodically change these Terms of Service. If so, the revised Terms of Service will be posted to the web site. By continuing to use Skylight Systems after any such changes are posted, all Users accept the Terms of Service, as modified. DISCLAIMERS The materials available on this site including, but not limited to editorial content, presentations and software are provided "as is" and to the fullest extent permissible pursuant to applicable law, Skylight Systems disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Skylight Systems does not warrant that this web site or any third-party sites will be uninterrupted or error-free, that defects will be corrected, or that this site, including the servers that make it available, are free of viruses or other harmful components. ON-LINE COMMERCE This site may allow a User to purchase different types of products and services that are provided either by Skylight Systems or third-parties. Skylight Systems is not responsible for the quality, accuracy, timeliness, reliability or any other aspect of these products and services. All Users release Skylight Systems, its subsidiaries and parent companies or its affiliates from any damages that may be incurred, and agree not to assert any claims against Skylight Systems, arising from the Users' purchase or use of any products or services made available by Skylight Systems or third-parties through the Service. In any event, damages are limited to refund or replacement on products and services purchased directly from Skylight Systems through the Service. LIMITATION OF LIABILITY Under no circumstances, including, but not limited to, negligence, shall Skylight Systems, its subsidiaries and parent companies or affiliates be liable for any direct, indirect, incidental, special or consequential damages that result from the use of, or the inability to use, Skylight Systems' materials, products or services, or third-party materials, products or services made available by Skylight Systems or the Service. Users specifically acknowledge and agree that Skylight Systems is not liable for any defamatory, offensive or illegal conduct of any User. If a User is dissatisfied with any Skylight Systems' materials, products or services or with any of Skylight Systems' terms and conditions, the User's sole and exclusive remedy is to discontinue using the Service. TERMINATION Skylight Systems may cancel or terminate a User's right to use the Service or any part of the Service at any time without notice. In the event of termination, such User is no longer authorized to access the Service or such part of the Service affected by such cancellation or termination. The restrictions imposed upon a User with respect to material downloaded from the Service, and the disclaimers and limitations of liabilities set forth in these Terms of Service shall survive the cancellation or termination of any User's right to use the Service or any part thereof. EMPLOYMENT This website allows Users to apply for employment opportunities with Skylight Systems. By submitting a resume or other information (the "Information") to be considered for employment by Skylight Systems, Users certify that the Information provided is true and complete to the best of their knowledge and agree that falsified information or significant omissions may disqualify Users from consideration for employment and, if employed, may result in dismissal when discovered. By submitting the Information, Users authorize Skylight Systems to make such inquiries of third parties as may be necessary in arriving at an employment decision and hereby release employers, schools or persons from all liability in responding to inquiries regarding the User or the Information. OTHER These Terms of Service shall be governed by the laws of the Commonwealth of Pennsylvania without giving effect to any principles or conflicts of law and without regard to any rule of construction or interpretation relating to which party prepared these Terms of Service. If any provision of these Terms of Service shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from the remaining Terms of Service and shall not effect the validity and enforceability of any remaining provisions. The Terms of Service constitute the entire agreement between Skylight Systems and the Users with respect to the subject mater contained in the Terms of Service and supercedes all previous and contemporaneous agreements, proposals and communications, written or oral. Users may also be subject to additional terms and conditions that may apply when the Users use the products or services of a third-party that are provided through the Service. In the event of any conflict between any such third-party terms and conditions and these Terms of Service, these Terms of Service shall govern. |
